Terms of Use
Last updated — 3 August 2026These terms govern your use of the XPhotos website and set out the basis on which we quote and license our work. By using this site or submitting a booking request, you agree to them. The commercial terms of any individual shoot are set out in the quote, call sheet and invoice we issue for that engagement — where those documents conflict with this page, those documents govern.
Using this website
You may view and share this site for the purpose of evaluating or engaging our services. You may not scrape it, republish its contents, or use it to train a machine-learning model without our written permission. Do not attempt to interfere with the site's operation or gain access to any system behind it.
Booking requests are not a confirmed booking
Submitting the form on this site is a request, not a contract. A date is only held once we confirm it in writing and issue a call sheet. Availability, particularly for golden-hour and twilight windows, is limited and allocated in the order requests are confirmed.
Pricing and quotes
Package prices shown on this site are in Canadian dollars, exclude applicable taxes, and cover the Lower Mainland and Sea-to-Sky corridor. Travel beyond that area, additional square footage, extended schedules, rush delivery and re-shoots are quoted separately. Prices are indicative and may change; the price in your written quote is the price that applies.
Deposits, cancellation and rescheduling
- No deposit is taken until the call sheet is confirmed
- Rescheduling is free with at least 48 hours' notice, subject to availability
- Cancellation inside 48 hours, or a property that is not accessible or not ready at the scheduled time, may be charged at up to the full package rate
- We may reschedule for weather where it materially affects exterior, twilight or aerial coverage, and will offer the next available window at no additional cost
Client responsibilities
To deliver on schedule we need the property ready when we arrive. The client is responsible for arranging access, confirming the property is staged and tidy, notifying any occupants or tenants in advance, and obtaining consent from anyone who may appear in the imagery. Time spent waiting for access or preparing the property is billable.
Ownership and licensing
XPhotos retains copyright in all photographs, video and other materials we produce, as author under the Copyright Act (Canada). On payment in full, the client receives a non-exclusive, non-transferable licence to use the delivered imagery to market the specific property it depicts — including MLS, the brokerage website, portals, social media, print collateral and advertising.
That licence does not extend to:
- Resale, sublicensing or transfer of the imagery to a third party, including another brokerage or a subsequent listing agent
- Use by the developer, builder, stager, architect or vendor unless separately licensed
- Use to promote a different property, or general brand advertising unrelated to the listing
- Submission to stock libraries or use as training data for machine-learning systems
Please do not crop, recolour, add filters to, or apply overlays that materially alter the imagery. Where practical, credit XPhotos. The licence ends if the invoice is not paid in full.
Our portfolio use
We may display delivered work in our portfolio, on this website and on social media. If a property or client requires confidentiality, tell us in writing before the shoot and we will exclude it.
Delivery
Delivery timelines quoted on this site — including 24-hour gallery delivery and next-morning delivery on the Signature package — run from the completion of the shoot and assume the shoot proceeded as scheduled. Multi-day, aerial and film deliverables follow the schedule in the call sheet.
Revisions and re-shoots
Each engagement includes one round of reasonable editing revisions. Re-shoots required because of a change in staging, styling or the client's requirements are quoted as new work. If we make an error, we will correct it or re-shoot at our cost.
Liability
We carry commercial liability insurance and fly under Transport Canada RPAS certification. To the extent permitted by law, our total liability arising from an engagement is limited to the fees paid for that engagement, and we are not liable for indirect or consequential loss — including lost sales, lost commission or lost opportunity. Nothing in these terms limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have exclusive jurisdiction.
